P2M Waiver and Release of Liability

Governing Entity: Pathway 2 Majors (P2M)

By completing registration and agreeing to this form electronically, I, the undersigned participant (or legal guardian of a minor participant), acknowledge that I have read, understood, and agreed to this Waiver and Release of Liability in full. This waiver is legally binding and applies to all P2M teams, events, activities, and services whether in person or online.

  1. Assumption of Risk
    I understand and acknowledge that participation in baseball and other sports-related activities organized or hosted by Pathway 2 Majors (P2M) involves inherent and unpredictable risks, including but not limited to: collisions, equipment failures, environmental conditions, and the negligence of others. These risks can result in serious bodily injury, illness, permanent disability, emotional distress, or death.
    • I voluntarily assume full responsibility for all risks, known or unknown, associated with participation, including those arising from the acts or omissions of P2M, its employees, agents, volunteers, and independent contractors.
    • Notice of Inherent Risks at Sports Facilities
    • Outdoor and indoor sports facilities—such as baseball, softball, and soccer fields, as well as basketball courts—naturally present certain risks due to their design and intended use. These inherent hazards may include, but are not limited to:
    • Uneven or inconsistent walking surfaces, seating areas, and bleachers, which may vary in design, construction, and condition.
    • The potential for injuries caused by collisions with other individuals, slips or falls on walkways, bleachers, and stairways, or tripping over objects left behind by others.
    • The risk of being struck by flying objects such as balls, bats, gloves, or other sports equipment, which may be thrown or deflected unexpectedly.
    • The possibility that players, coaches, team personnel, or spectators may unintentionally cause damage to the facility or create hazards, without the knowledge of P2M or the event host.
    • This list is not exhaustive. Additional, unforeseen risks may also be present and could result in injury. All attendees—including players, coaches, team personnel, and spectators—should remain attentive to the ongoing activities and be alert for objects moving in their direction. Public safety announcements should also be followed at all times during any event.
    • Everyone on the premises is responsible for their own safety while attending any event. If you are not willing to accept the risks associated with attending or participating in such events, you should refrain from entering the facility.
    • P2M is not liable for any injuries sustained by players, coaches, team personnel, or spectators during an event.
  2. Waiver and Release of Liability
    In consideration for being permitted to participate in P2M events or activities, I hereby release, discharge, and hold harmless Pathway 2 Majors and its directors, officers, employees, agents, contractors, volunteers, successors, and assigns (collectively “Released Parties”) from any and all claims, liabilities, losses, demands, causes of action, damages, costs, or expenses (including attorneys’ fees) arising out of or related to my (or my child’s) participation in any P2M activity, including but not limited to claims for negligence, injury, illness, death, or property damage.
    • This waiver is intended to be as broad and inclusive as permitted by law and shall be governed by the laws of the State of North Carolina. If any portion is found unenforceable, the remaining terms shall remain in full force and effect.
  3. Acknowledgment of Cancellation Policy
    I understand and agree that P2M is not responsible for any travel expenses, accommodations, registration fees, or other incidental costs incurred as a result of cancellations by the event host or P2M, regardless of cause, including but not limited to weather, team withdrawal, lack of team formation, illness, facility closure, or force majeure.
    • I acknowledge that refunds or credits are only issued if the tournament is canceled in full with no games played or a roster cannot be filled and P2M cancels the team.
  4. Event host and P2M Performance Guidelines and Rules
    All participants, coaches, spectators, parents, and staff are expected to adhere to the guidelines and general rules set forth by the event host and P2M. These standards are in place to ensure a safe, respectful, and fair environment for everyone involved. Failure to comply with these guidelines and rules may result in disciplinary action, which may include a verbal warning, temporary or permanent removal from the event, disqualification of a participant or team, forfeiture of any associated fees, and potential suspension from future P2M teams, activities, or events. These consequences will be enforced at the sole discretion of event staff and P2M representatives, based on the nature and severity of the violation. By attending or participating in any P2M teams or activity, all individuals acknowledge their responsibility to uphold these standards.
  5. Medical Authorization and Responsibility
    I hereby authorize P2M staff, volunteers, and representatives to administer first aid and/or obtain emergency medical treatment on my behalf or on behalf of the minor participant in the event of illness or injury. I understand that reasonable efforts will be made to contact me or an emergency contact prior to treatment, if possible.
    • I acknowledge and agree that P2M, its staff, volunteers, and representatives assume no liability for any injury, loss, or damage incurred in connection with such care. I understand and agree that I am financially responsible for all medical care and treatment provided.
  6. Consent to Use of Image and Media
    I hereby grant P2M the right to photograph, video record, or otherwise capture the likeness of the participant during P2M activities. I understand these images and recordings may be used by P2M for promotional, educational, commercial, or informational purposes across any media now known or later developed, without further permission, notice, or compensation.
  7. Electronic Agreement and Authorization
    By checking the box or electronically submitting this form on the P2M website, I acknowledge that this action constitutes a legally binding electronic signature and acceptance of the above Waiver and Release of Liability. I certify that I am 18 years of age or older, or the legal guardian of the minor participant listed on this registration.
