Website Terms of Use Agreement

PLEASE READ THESE TERMS OF USE (“Terms”) CAREFULLY BEFORE ACCESSING OR USING THIS WEBSITE (THE “Website”), WHICH IS OPERATED BY PATHWAY 2 MAJORS (“P2M” OR THE “OPERATORS”). BY ACCESSING OR USING THE WEBSITE, YOU HEREBY AGREE TO BE BOUND BY THESE TERMS, AS WELL AS OUR PRIVACY POLICY, AMENDED FROM TIME TO TIME IN ACCORDANCE WITH THESE TERMS. THESE TERMS APPLY GLOBALLY TO ALL USERS, REGARDLESS OF LOCATION.
1. Definitions
For the purposes of this Agreement, the following terms shall have the meanings set forth below:
- “Content” shall mean any information, text, graphics, images, videos, or other materials that you upload, download, or otherwise make available on the Website.
- “Materials” shall refer to all proprietary content, features, and functionalities provided by Pathway 2 Majors on the Website.
- “Message Features” shall denote any mode of communication offered on the Website, including, but not limited to, email, blogs, chats, or message boards.
- “Username” shall mean the pseudonym selected by you for use on the Website.
- “Operators” shall mean Pathway 2 Majors, its affiliates, employees, directors, officers, agents, and representatives.
2. Modification and Notice
Pathway 2 Majors reserves the unequivocal right to modify these Terms at any time. In the event of any material modifications that affect your rights or obligations, a prominent notice shall be posted exclusively on the Terms and Conditions page of the Website. All updates and notifications regarding such modifications will be provided solely through that page. The modified Terms shall become effective immediately upon posting the notice.
Users are solely responsible for reviewing the Terms and Conditions page periodically to stay informed of any updates. Continued use of the Website after modifications are posted constitutes acceptance of the revised Terms.
If you do not agree to these modifications, you must immediately discontinue your use of the Website.
3. Compliance with Privacy Laws
Pathway 2 Majors complies with applicable privacy laws, including but not limited to:
- General Data Protection Regulation (GDPR) for users in the European Union (EU), granting rights related to data access, modification, and deletion.
- California Consumer Privacy Act (CCPA) for California residents, allowing them to opt out of data collection and request information about stored data.
- Children’s Online Privacy Protection Act (COPPA) restrictions for minors under the age of 13.

4. Website Ownership; Use of Website; and Content
The Website is the property of and is operated by Pathway 2 Majors. All Materials presented on the Website are either owned by or duly licensed to Pathway 2 Majors. Except for the limited right to download a single copy of the Materials for personal, non-commercial use on one computer, you shall not, without the express prior written consent of Pathway 2 Majors, reproduce, prepare derivative works from, distribute, perform, or display any Materials.
Subject to these Terms, Pathway 2 Majors grants you a non-exclusive, limited, non-transferable, and revocable license to access and use the Website. All rights not expressly granted hereunder are reserved by Pathway 2 Majors.
5. Copyright and Intellectual Property Enforcement
Pathway 2 Majors actively enforces its intellectual property rights. Unauthorized use of copyrighted content may result in legal action, including Digital Millennium Copyright Act (DMCA) takedown requests. Users found to infringe intellectual property rights may have their accounts suspended or terminated and could be subject to further legal consequences.
If you believe that your copyrighted work has been improperly used on the Website, please contact Pathway 2 Majors.
6. User Content and License
“Content” means any material that you submit, post, display, or otherwise make available on the Website. By submitting any Content, you represent and warrant that you possess all requisite rights to do so, and you hereby grant Pathway 2 Majors a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, adapt, modify, publish, and display such Content in connection with the Website. This license shall remain in effect solely for as long as your Content remains publicly accessible on the Website.
Upon removal of your Content by you, Pathway 2 Majors shall, where reasonably practicable, cease further use of such Content; however, any prior use or distribution shall not be retroactively affected.
In addition, by participating in Pathway 2 Majors coached events or activities, you acknowledge and agree that Pathway 2 Majors has the right to photograph and/or record players and participants, and to use such photographs and recordings for promotional, website, marketing, and advertising purposes, in any media format, without further permission or compensation.
7. Terms of Service for Minors
Pathway 2 Majors restricts Website use for individuals under the age of 13. Users between the ages of 13-18 must obtain parental or legal guardian consent to create an account or submit any personal information.
Pathway 2 Majors does not knowingly collect personal data from children under 13. Any such data discovered will be immediately deleted upon verification.
8. User Consent for Contact by Coaches or Scouts
By using the Website and associated services, you acknowledge and agree that Coaches and Scouts affiliated with Pathway 2 Majors (“P2M”) may contact you for the following authorized purposes:
- Invitations to P2M-listed events, showcases, tryouts, and recruitment-related programs.
- Communications regarding potential recruitment opportunities for college or professional baseball teams.
- Coordination of event logistics, player evaluations, or scouting inquiries relevant to P2M activities.
You further consent to receiving email, phone, or other electronic communications from authorized Coaches or Scouts solely for P2M-related purposes. You understand that any unauthorized solicitation, marketing, or third-party distribution of your contact information by a coach or scout is strictly prohibited under these Terms.
If you wish to withdraw consent for contact, you may do so by adjusting your account settings or submitting a written request to Pathway 2 Majors’ support team. This may result in account deletion.
9. Arbitration and Class Action Waiver
To the extent permitted by law, all disputes, claims, or controversies arising from or related to these Terms shall be resolved through binding arbitration, rather than litigation. Arbitration shall be conducted in Wilmington, North Carolina, in accordance with the rules of the American Arbitration Association (AAA).
Exceptions to arbitration include:
- Claims seeking injunctive relief (such as intellectual property disputes).
- Disputes explicitly prohibited by applicable law from arbitration.
Each party shall bear its own arbitration costs unless otherwise determined in the arbitration ruling.
Class Action Waiver: “You waive any right to participate in a class-action lawsuit or class-wide arbitration against Pathway 2 Majors. All claims must be brought in an individual capacity.”
10. Termination
Pathway 2 Majors reserves the right, in its sole discretion, to suspend or terminate your access to the Website and events without prior notice. The following may also result in immediate suspension, termination, law enforcement, and/or legal action:
- User Violations – If you breach these Terms of Use, including but not limited to unauthorized content sharing, fraudulent activity, criminal activity, child exploitation, or violating intellectual property rights.
- Legal Compliance – If required by law, court orders, or government regulations.
- Business Decisions – If Pathway 2 Majors chooses to discontinue services, modify offerings, or undergo structural changes affecting service availability.
- Security Threats – If your account activity is linked to unauthorized access, cyberattacks, or risks to the integrity of the Website.
- Unauthorized Contact – Coach and Scout accounts are granted exclusive access to contact information, which is strictly limited to the purpose of coordinating P2M-listed event invitations, event-related communications, and facilitating recruitment efforts for potential college or professional baseball team placement. Any use of this contact information outside of these explicitly authorized purposes, including but not limited to personal solicitation, unauthorized marketing, or third-party distribution, shall constitute a violation of these Terms. Pathway 2 Majors reserves the right to immediately suspend or terminate any account found to be engaging in unauthorized contact or misuse of confidential information.
- Event host and P2M Performance Guidelines and Rules – All participants, coaches, spectators, and staff are expected to adhere to the guidelines and general rules set forth by the event host and P2M. These standards are in place to ensure a safe, respectful, and fair environment for everyone involved. Failure to comply with these guidelines may result in disciplinary action, which may include a verbal warning, temporary or permanent removal from the event, disqualification of a participant or team, forfeiture of any associated fees, and potential suspension from future P2M events. These consequences will be enforced at the sole discretion of event staff and P2M representatives, based on the nature and severity of the violation. By attending or participating in any P2M teams or activity, all individuals acknowledge their responsibility to uphold these standards.
Violation of these clauses may result in further legal action, including but not limited to injunctive relief and financial damages if misuse causes reputational or financial harm to Pathway 2 Majors or third parties.
Upon termination, all rights granted to you under these Terms will immediately cease, and you must discontinue all access to the Website. Pathway 2 Majors is not liable for any damages resulting from termination.
11. Accessibility Compliance
Pathway 2 Majors is committed to providing an accessible website experience and adheres to applicable accessibility laws, including the Americans with Disabilities Act (ADA) and Web Content Accessibility Guidelines (WCAG).

12. Travel and Expense Liability Disclaimer
Pathway 2 Majors shall not be held liable for any travel-related expenses or incidental costs incurred by participants, guardians, or attendees in connection with any scheduled event, tournament, or activity. This includes, but is not limited to, expenses for transportation, lodging, meals, fuel, or other associated costs.
This disclaimer applies regardless of the reason for cancellation, postponement, modification, or rescheduling of an event, whether initiated by P2M, the event host, venue, or any third party, and regardless of notice or timing. All such expenditures are made at your sole risk and discretion.
P2M strongly recommends that participants consider obtaining travel insurance or refundable arrangements where possible.
13. Assumption of Risk and Release of Liability
By attending or participating in any event, tournament, or activity organized by P2M, you acknowledge and voluntarily accept the inherent risks associated with athletic participation. These risks include, but are not limited to, serious bodily injury, permanent disability, illness, property damage, and death.
You further agree that participation is entirely voluntary and undertaken at your own risk. To the fullest extent permitted by law, you, on behalf of yourself, your minor child(ren), and any representatives or heirs, hereby release, waive, and discharge P2M, its officers, directors, employees, affiliates, agents, and volunteers from any and all claims, liabilities, demands, or causes of action arising out of or related to participation in such events.
Notice of Inherent Risks at Sports Facilities
Outdoor and indoor sports facilities—such as baseball, softball, and soccer fields, as well as basketball courts—naturally present certain risks due to their design and intended use. These inherent hazards may include, but are not limited to:
- Uneven or inconsistent walking surfaces, seating areas, and bleachers, which may vary in design, construction, and condition.
- The potential for injuries caused by collisions with other individuals, slips or falls on walkways, bleachers, and stairways, or tripping over objects left behind by others.
- The risk of being struck by flying objects such as balls, bats, gloves, or other sports equipment, which may be thrown or deflected unexpectedly.
- The possibility that players, coaches, team personnel, or spectators may unintentionally cause damage to the facility or create hazards, without the knowledge of P2M or the event host.
This list is not exhaustive. Additional, unforeseen risks may also be present and could result in injury. All attendees—including players, coaches, team personnel, and spectators—should remain attentive to the ongoing activities and be alert for objects moving in their direction. Public safety announcements should also be followed at all times during any event.
Everyone on the premises is responsible for their own safety while attending any event. If you are not willing to accept the risks associated with attending or participating in such events, you should refrain from entering the facility.
P2M is not liable for any injuries sustained by players, coaches, team personnel, or spectators during an event.
14. Acceptance of Terms
By accessing or using the Website and playing on P2M teams, you acknowledge that you have read, fully understand, and agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue further use of the Website.
